Terms of Service for Artisans & Professionals

By registering on Flexi Book Services, you agree to the following terms:

  1. You confirm that you are at least 18 years of age, of sound mind, and legally competent under Ghanaian law to enter into this binding agreement, and that all information, identification documents (including your Ghana Card) and qualifications submitted are true, accurate and verifiable.
  2. You acknowledge that you are an independent contractor and not an employee, agent, partner or joint venturer of Flexi Book Services, and that you are solely responsible for your taxes (PAYE, VAT, NHIL, GETFund, COVID-19 Levy where applicable), social security (SSNIT), insurance, tools, transport and statutory permits.
  3. Service prices, scope and turnaround displayed on your profile must be accurate, transparent and fair, and must comply with the Sale of Goods Act, 1962 (Act 137) and the Public Health Act, 2012 (Act 851) where relevant.
  4. All customer payments must be processed through Flexi Book Services. Customers pay a non-refundable Connection Fee (GHS 20 – GHS 100), a 3% Customer Service Charge and a minimum 30% deposit before your full contact details are released.
  5. Flexi Book Services charges a service Commission of 10% – 20% on the total job value of every booking facilitated through the Platform; Commission must be remitted within 24 hours of service delivery, failing which your account may be suspended without further notice.
  6. Funds (less Commission and processing fees) are released to your verified mobile-money or bank account only after the customer marks the job completed and the standard 7-day dispute window has closed without an unresolved complaint.
  7. You agree to deliver professional, honest, safe and quality services at all times, to honour all confirmed bookings, to arrive punctually, and to respect customer property, privacy, dignity and household composition.
  8. Flexi Book Services is a neutral marketplace and is NOT a party to the contract between you and the customer; we are not liable for the quality, safety, legality, timing, outcome, damages, delays, injuries or losses arising from any service you perform.
  9. Fraud, identity theft, fake credentials, off-platform solicitation to evade fees, scams, sexual harassment, discrimination, theft, violence, possession of illegal substances on the job, or any other illegal activity are strictly prohibited and may result in immediate suspension, permanent ban, forfeiture of pending payouts, civil recovery action, and reporting to the Ghana Police Service or the Economic and Organised Crime Office (EOCO).
  10. You agree NOT to bypass the Platform on any introduction made through Flexi Book Services. Bypass is a breach of contract and you agree to pay liquidated damages equal to three (3) times the unpaid Commission plus all reasonable recovery costs, recoverable as a debt due in the courts of Accra.
  11. Customer reviews, ratings and complaint outcomes may be publicly displayed on your profile. We do not edit reviews to protect Artisans, but we will remove content that is abusive, defamatory or demonstrably fake.
  12. You grant Flexi Book Services a worldwide, royalty-free, non-exclusive, transferable licence to host, display, reproduce and adapt the photos, descriptions and content you upload for the operation, marketing and promotion of the Platform.
  13. You consent to the collection, processing, storage and limited sharing of your personal data and ID documents in accordance with the Data Protection Act, 2012 (Act 843), the Cybersecurity Act, 2020 (Act 1038) and our Privacy Policy, including for identity verification, fraud prevention, regulatory compliance and operational purposes.
  14. Flexi Book Services reserves the right to suspend, restrict, downgrade or terminate your account at its reasonable discretion for breach of these Terms, repeated low ratings, no-shows, fraud, unsafe conduct, or where required by law or competent authority.
  15. Flexi Book Services may update these Terms at any time by notice on the Platform, by email, SMS or WhatsApp; continued use of your account after the effective date constitutes your acceptance of the updated Terms.
  16. This agreement is governed by the laws of the Republic of Ghana. Disputes will first be settled amicably, then by mediation in Accra under the Alternative Dispute Resolution Act, 2010 (Act 798), and failing that by the exclusive jurisdiction of the competent courts of Accra.

This Artisan Agreement (“Agreement”) is between you (the “Artisan”) and Flexi Book Services, trading as Flexi Book Services. It supplements our general Terms & Conditions and Privacy Policy. By creating an Artisan account you accept this Agreement.

1. Independent contractor status

You are an independent service provider, not an employee, agent, or partner of Flexi Book Services. You are responsible for your own taxes, social security, business registration, tools, insurance, and compliance with Ghanaian law (including any trade licences required for your craft).

2. Account and listings

  • You must provide accurate identity, contact, and location information.
  • Your profile and services are subject to review and approval before going live.
  • You may not impersonate another person or list services you are not qualified to perform.
  • Photos you upload must be your own or used with the owner’s permission.

3. Service standards

  • Respond to booking requests promptly and respectfully.
  • Honour confirmed bookings and arrive on time.
  • Deliver work to a professional standard and respect customer property.
  • Do not solicit customers off-platform to avoid commission.
  • Do not engage in any form of harassment, discrimination, or fraud.

4. Pricing, fees, commission and payment

  • You set your own prices. Final pricing may be agreed with the customer at confirmation.
  • Customers pay a mandatory, non-refundable connection fee of GHS 20 – GHS 100 (depending on service type) on every booking. This fee is retained by Flexi Book Services.
  • Flexi Book Services charges a service commission of 10% – 20% on the total job value of every booking facilitated through the Platform. The commission may be paid by the customer, deducted from your payout, or split between you and the customer.
  • Customers must pay a minimum 30% deposit upfront before your full contact details are released to them.
  • Where in-platform payments are used, the remaining balance is released to your registered mobile-money or bank account once the job is marked completed and confirmed by the customer, net of commission and processing fees.
  • Where the customer settles the balance offline, the booking remains subject to the connection fee and commission above. You are responsible for issuing receipts and accounting.

4a. Optional Pro subscription

We offer an optional Pro tier (currently GHS 100 / month) that unlocks priority listing placement and access to more leads. The Free tier remains available with limited job access. Subscription is optional and can be cancelled at any time.

4b. Anti-bypass

You agree not to bypass the Platform to avoid the connection fee, deposit, or commission on any introduction made through Flexi Book Services. Soliciting customers off-platform, sharing personal contact details before payment, or arranging repeat bookings outside the Platform may result in:

  • Suspension or termination of your account;
  • A permanent ban from the Platform;
  • Recovery of unpaid platform fees.

⚠️ Commission payment policy

Commission must be paid within 24 hours after service delivery, using the service delivered as a reference for payment. Failure to pay it within 24 hours without a written reasonable cause may result in the outright suspension of the account.

5. Taxes

You are solely responsible for declaring and paying all taxes due on your earnings to the Ghana Revenue Authority. We may share information with tax authorities where required by law.

6. Insurance and safety

You are responsible for any tools, vehicles, or materials you bring to a job and for ensuring you can safely perform the work. We strongly recommend appropriate public liability insurance.

7. Reviews

Customers can post reviews of your work. We do not edit reviews to protect Artisans, but we will remove reviews that are abusive, irrelevant, or appear fake. You may respond professionally where the feature is enabled.

8. Suspension and termination

We may suspend or remove your account at our reasonable discretion if you:

  • Receive repeated low-quality complaints or fail to honour bookings;
  • Engage in fraud, harassment, or unsafe conduct;
  • Bypass the Platform to evade commission;
  • Breach this Agreement or applicable Ghanaian law.

You may close your account at any time after settling outstanding bookings.

9. Liability and indemnity

You are solely liable for the services you perform and for any harm caused by your negligence, wilful misconduct or breach of law. You agree to indemnify and hold harmless Flexi Book Services, its officers, employees and agents from any claims, damages, fines and reasonable legal fees arising from your services, your breach of this Agreement or your violation of applicable Ghanaian law. Flexi Book is not a party to the contract you make with the customer and is not liable for your work or omissions.

10. Confidentiality and data

You may receive personal data of customers (name, phone, address) to perform a booking. You may use it only for that booking, store it securely in line with the Data Protection Act, 2012 (Act 843), and you must not sell, share or use it for unrelated marketing. Breach may give rise to civil and criminal liability.

11. Anti-bribery, anti-money laundering and sanctions

You will comply with the Anti-Money Laundering Act, 2020 (Act 1044), anti-bribery laws and applicable sanctions regimes. You will not offer or accept improper payments and you will report suspicious requests to us promptly.

12. Health, safety and standards

You will work in line with the Labour Act, 2003 (Act 651) and any safety standards relevant to your craft (e.g. electrical wiring code, gas handling). You are responsible for the safety of yourself, any assistants and the customer’s premises. We strongly recommend public liability and tools-in-trade insurance.

13. Intellectual property licence

By uploading photos, descriptions, logos or other content, you grant Flexi Book a worldwide, royalty-free, non-exclusive, transferable licence to host, display, reproduce and adapt that content for the operation, marketing and promotion of the Platform. You warrant that you own or have permission to use the content.

14. Electronic signature and notices

You agree that ticking the acceptance box and clicking “Create account” (or any similar action) is your electronic signature under the Electronic Transactions Act, 2008 (Act 772) and binds you to this Agreement. We will give you notices via the Platform, email, SMS or WhatsApp.

15. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including acts of God, government action, civil unrest, pandemic, power or telecommunications failure or strikes.

16. Changes

We may update this Agreement. We will notify you of material changes via the Platform, email or WhatsApp. Continued use of your account after the effective date means you accept the new version.

17. Governing law and dispute resolution

This Agreement is governed by the laws of the Republic of Ghana. Disputes will first be resolved amicably, then by mediation in Accra under the Alternative Dispute Resolution Act, 2010 (Act 798), and failing that by the competent courts of Accra.

18. Identity verification, Ghana Card and background checks

You consent to (and warrant the accuracy of) the submission of your Ghana Card or other government-issued ID, your photograph, and your address for identity verification under the National Identification Authority Act, 2006 (Act 707). You authorise Flexi Book Services and its verification partners to confirm your identity, qualifications, criminal record (where lawfully accessible) and references with the Ghana Police Service, the National Identification Authority, professional bodies and any guarantor you nominate. Submission of forged or altered documents is a criminal offence and a fundamental breach of this Agreement.

19. Restrictive covenant — non-circumvention

For the duration of your account and for twelve (12) months after its termination, you will not directly or indirectly solicit, contract with, or accept work from any customer first introduced to you through the Platform on terms that bypass the Connection Fee, Service Charge, Deposit or Commission. You agree this covenant is reasonable to protect Flexi Book’s legitimate business interest in its customer database and goodwill.

20. Liquidated damages and payout set-off

Where you breach the anti-bypass or restrictive covenant clauses, you agree to pay Flexi Book liquidated damages of three (3) times the Commission and Connection Fee that would otherwise have been payable on the bypassed booking, plus reasonable recovery and legal costs. We may, without prior notice, set off any such damages, unpaid Commission, chargebacks or refunds against any payout, wallet balance or deposit we hold for you.

21. Subscription, listing fees and pricing changes

The optional Pro subscription is currently GHS 100 / month, billed in advance and non-refundable for the current billing cycle. Connection Fees, Commission rates, Pro pricing and category-specific surcharges may be revised from time to time on at least 14 days’ notice via the Platform, email, SMS or WhatsApp; continued use of your account after the effective date constitutes acceptance.

22. No class actions; individual disputes only

To the maximum extent permitted by Ghanaian law, you and Flexi Book agree that any dispute arising out of this Agreement will be resolved on an individual basis. You waive any right to bring or participate in a class, representative or consolidated action against Flexi Book, its officers, employees, agents, affiliates or shareholders.

23. Survival and assignment

Sections covering Commission owed, liquidated damages, anti-bypass, restrictive covenant, intellectual property licence, indemnity, liability, set-off, governing law and dispute resolution survive termination. You may not assign this Agreement without our prior written consent. We may assign it to an affiliate or successor in connection with a merger, reorganisation or sale of assets.

24. Severability and entire agreement

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. This Agreement (together with the Terms & Conditions, Privacy Policy and Cookie Policy) is the entire agreement between you and Flexi Book regarding your use of the Platform as an Artisan and supersedes all prior understandings.
